Auction Terms of Sale

By registering to bid and participating in any auction on Tradyard.com, you agree to be bound by these Terms of Sale. These terms constitute a legal agreement between you (the "Buyer") and Tradyard Inc. (the "Auctioneer").

All bids placed are legally binding. Once the auctioneer's hammer falls, a binding contract is formed between the highest bidder and the seller.

Buyer's Premium: An 18% premium is added to the hammer price of each lot purchased. This premium is subject to applicable taxes.

Taxes: Harmonized Sales Tax (HST) of 13% applies to both the hammer price and buyer's premium for Ontario buyers. Provincial sales tax rates apply for other provinces.

Shipping Fees: Shipping, handling, and insurance costs are NOT included in the hammer price and will be calculated separately based on destination and package size.

Payment Deadline: Full payment is due within 7 calendar days of the auction close. Failure to pay within this period may result in account suspension and legal action.

Accepted Payment Methods:

• Credit Card (Visa, Mastercard, American Express)
• Debit Card
• Wire Transfer (for purchases over $5,000)

Deposit Authorization: Some auctions may require a refundable deposit to be authorized before bidding. This deposit is held as security and will be refunded to non-winning bidders within 5 business days.

Authenticity Guarantee: If an item is proven to be counterfeit or materially misrepresented in the auction description, you may return it within 14 days for a full refund including buyer's premium.

Shipping Damage: Items damaged during shipping must be reported within 48 hours of delivery with photographic evidence. Claims must be filed with the carrier.

Condition Disputes: All lots are sold as-is. Descriptions and condition reports are provided in good faith but are not guaranteed. Buyers are encouraged to inspect items or request additional photos before bidding.

Shipping Responsibility: Buyers are responsible for all shipping, handling, and insurance costs. Shipping quotes will be provided after payment is received.

Pickup Options: Local pickup may be available for some lots. Coordination must be made within 14 days of payment or storage fees will apply.

Insurance: All shipped items are fully insured. Insurance cost is included in the shipping quote.

International Shipping: Buyers are responsible for all customs duties, import taxes, and brokerage fees. Declared value will match the invoice amount including buyer's premium.

Binding Bids: All bids are legally binding. Do not bid unless you intend to complete the purchase.

Proxy Bidding: Our platform supports proxy (automatic) bidding. Your maximum bid will be used to automatically outbid other bidders up to your specified amount.

Bid Increments: Minimum bid increments are determined by the current price and cannot be overridden.

Anti-Sniping: If a bid is placed in the final 2 minutes, the lot closing time will be extended by 2 minutes to allow fair bidding.

Prohibited Conduct: Bid manipulation, shill bidding, collusion, or any fraudulent activity will result in immediate account termination and legal action.

Governing Law: These terms are governed by the laws of the Province of Ontario, Canada.

Mediation: Any disputes arising from auction transactions must first be submitted to mediation before legal action.

Auctioneer's Decision: In case of bidding disputes, the auctioneer's decision is final and binding.

Description Accuracy: Sellers must provide accurate and honest descriptions of all items. Misrepresentation may result in account suspension.

Delivery Timeline: Sellers must ship or prepare items for pickup within 5 business days of receiving payment.

Commission: Sellers pay a 5% commission on the hammer price plus applicable transaction fees.
